Terms of Service

These Terms of Service ("Terms") govern your access to and use of MAGNO Dispatch (the "Service"), an AI-powered phone receptionist platform operated by MAGNO Junk Removal LLC, located at 1081 Citrus Landing Blvd, Davenport, FL 33837 ("MAGNO Dispatch," "we," "us," or "our"). By creating an account, clicking "I agree," or using the Service, you ("Subscriber," "you," or "your") agree to these Terms. If you do not agree, do not use the Service.
1. The Service
MAGNO Dispatch provides an automated, artificial-intelligence ("AI") voice agent that answers telephone calls on your behalf, collects caller information, sends text messages, and records call details in a dashboard. The Service is provided to businesses for commercial use only.
The AI agent is automated software. It may misunderstand callers, produce inaccurate information, or fail to capture details correctly. The Service is a lead-capture and answering tool and is not a substitute for professional, legal, medical, financial, or emergency services. You are responsible for reviewing and verifying all information captured by the Service.
2. Eligibility and Accounts
You must be at least 18 years old and authorized to act on behalf of a business located in the United States. You are responsible for the accuracy of your registration information, for maintaining the confidentiality of your account credentials, and for all activity under your account.
3. Subscriptions, Free Trial, Billing, and Cancellation
a. Plans and free trial. The Service is offered on recurring monthly subscription plans. We may offer a free trial period (currently 7 days). At the end of the free trial, your paid subscription begins automatically and your payment method will be charged the then-current monthly fee unless you cancel before the trial ends.
b. Recurring charges and auto-renewal. Your subscription renews automatically each billing cycle and your payment method is charged the applicable monthly fee plus any usage overage, until you cancel. The plan price, included minutes, and per-minute overage rate applicable to your plan are disclosed at sign-up and in your dashboard.
c. How to cancel. You may cancel at any time from your account dashboard or by emailing hello@magnodispatch.com. Cancellation takes effect at the end of the current billing cycle. To avoid being charged after the free trial, cancel before the trial period ends.
d. Payments. Payments are processed by Stripe, Inc. We do not store your full card number. You authorize us and Stripe to charge your payment method for all fees and applicable taxes.
e. Refunds. Fees are generally non-refundable except where required by law.
f. Price changes. We may change pricing on a prospective basis with at least 30 days’ notice; changes apply to your next billing cycle.
4. Call Recording, Monitoring, and Consent
The Service may record, transcribe, and store telephone calls handled by your AI agent.
Recording laws vary by state and are strict. Florida and several other states (including California, Illinois, Massachusetts, and others) require the consent of all parties to a call before it may be recorded. Florida’s Security of Communications Act (Fla. Stat. § 934.03) makes unlawful recording a criminal offense and creates civil liability.
You are solely responsible for ensuring that your use of the Service’s recording and transcription features complies with all applicable federal, state, and local wiretapping, eavesdropping, and call-recording laws in every jurisdiction where you or your callers are located. The AI agent can be configured to provide a recording disclosure at the start of calls (e.g., "This call may be recorded"), but you remain responsible for ensuring all required consents are obtained and for the lawful use of any recordings or transcripts. You represent and warrant that you have all authority and consents necessary to record calls through the Service.
5. Telephone and Text Message Compliance (TCPA)
The Service may send text messages (SMS) to your callers and to you. You are solely responsible for compliance with the Telephone Consumer Protection Act ("TCPA"), CTIA guidelines, carrier (10DLC/A2P) requirements, and all applicable laws governing calls and text messages sent to your customers, including obtaining any required consent, honoring opt-out ("STOP") requests, identifying your business, and observing permitted contact hours. You will not use the Service to send unlawful, unsolicited, or harassing communications.
6. Acceptable Use
You will not, and will not permit others to: (a) use the Service for any unlawful, fraudulent, deceptive, or harassing purpose; (b) impersonate any person or misrepresent your affiliation; (c) use the Service to collect sensitive personal information (e.g., Social Security numbers, payment card data, health information) from callers; (d) reverse engineer, scrape, or interfere with the Service; (e) resell or sublicense the Service without our written consent; or (f) use the Service in violation of any recording, telemarketing, or consumer-protection law.
7. Your Data and Content
As between you and us, you retain all rights to the business information you provide and to the call data captured on your behalf ("Subscriber Data"). You grant us a limited license to host, process, and use Subscriber Data to provide and improve the Service. For personal information of your callers, you are the data controller and we act as your service provider/processor; our handling of personal information is described in our Privacy Policy.
8. Intellectual Property
The Service, including all software, models, prompts, designs, and the MAGNO Dispatch name and branding, is owned by us or our licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service during your subscription. No other rights are granted.
9. Third-Party Services
The Service relies on third-party providers, including Stripe (payments), Twilio (telephony/SMS), ElevenLabs (voice AI), and others. Your use of features powered by these providers may be subject to their terms. We are not responsible for third-party services or outages.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE AI AGENT WILL BE ACCURATE, UNINTERRUPTED, ERROR-FREE, OR THAT IT WILL CAPTURE OR CONVEY INFORMATION CORRECTLY. YOU ASSUME ALL RISK ARISING FROM YOUR RELIANCE ON THE SERVICE.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST BUSINESS, OR LOST DATA, ARISING FROM OR RELATED TO THE SERVICE. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; SOME OF THE ABOVE MAY NOT APPLY TO YOU.
12. Indemnification
You will defend, indemnify, and hold harmless MAGNO Dispatch and its officers, owners, and affiliates from any claims, damages, liabilities, penalties, and costs (including reasonable attorneys’ fees) arising from: (a) your use of the Service; (b) your violation of any law, including call-recording, wiretapping, or TCPA laws; (c) the content of communications handled by your AI agent; (d) any claim by your callers or customers; or (e) your breach of these Terms.
13. Termination
You may cancel at any time as described in Section 3. We may suspend or terminate your access if you breach these Terms, fail to pay, or use the Service unlawfully. Upon termination, your license ends and we may delete your data after a reasonable period, subject to our Privacy Policy.
14. Changes to the Service and Terms
We may modify the Service or these Terms. We will post the updated Terms with a new "Last Updated" date and, for material changes, provide reasonable notice. Continued use after changes take effect constitutes acceptance.
15. Governing Law and Venue
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws principles. Any dispute will be brought exclusively in the state or federal courts located in Polk County, Florida, and you consent to their jurisdiction.
16. Miscellaneous
If any provision is unenforceable, the rest remains in effect. These Terms are the entire agreement between you and us regarding the Service. You may not assign these Terms without our consent; we may assign them. Our failure to enforce a provision is not a waiver. Neither party is liable for delays caused by events beyond its reasonable control.
